Before an employer can nominate a worker for an employer sponsored visa (482, 186 or 494), the employer must be approved as a Standard Business Sponsor.
For employers starting the sponsorship process
The sponsorship application is made to the Department. The employer must demonstrate that the business is lawfully operating, actively trading, and has no adverse information. The Department checks compliance history, workplace law compliance and tax obligations.
Sponsorship obligations you need to understand
Once approved, sponsors must: pay the worker at or above market salary rate, keep records, notify the Department of changes, cooperate with inspections, and not recover sponsorship costs from the worker. Breaching these obligations can result in civil penalties and bars on future sponsorship.
If your sponsorship application has been refused
Refusal of sponsorship approval is reviewable in some circumstances. Contact us to assess your options.
